ANDX Privacy Policy

 This privacy policy applies to www.andishere.com owned and operated by ANDX, LLC dba ANDX, and includes subsidiaries ANDX Inc. and MX ANDX S.A. de C.V. (“ANDX”). ANDX is committed to safeguarding the privacy of all personally identifiable information (“PII”).

For the purposes of this policy, ANDX defines the term “client” as a business with which ANDX has an established relationship and a “customer” as a customer of an ANDX client.

This privacy policy covers how ANDX handles personally identifiable information, including personally identifiable information associated with our website www.andishere.com, our survey hosting domains “websurvey.andishere.com”, “surveys.andishere.com”, “reportal.andishere.com”, and “and-agency.biz” for email survey invites.

INFORMATION ANDX COLLECTS

ANDX collects surveys and other market research data about consumer usage of products and services. The data is used by ANDX’s clients to improve the products and services offered to their customers.

ANDX does not receive, use or collect any PII, such as names, addresses, phone numbers and e-mail addresses, except for the following reasons:

  • Information that you provide to us by completing forms on our website. This includes information provided at the time of registering to use our website or subscribing to our services, including contact details such as name, employer, job title, email address, employer and personal mailing addresses, and phone numbers
  • Information that you share through our website by using our services, including any Personal Information in the data that you share
  • Information you provide to us when you contact us for customer or technical support or when you submit questions or comments
  • Information we receive from third-party search engines relating to your search activity
  • Details of your visits to and interaction with our websites including, but not limited to, traffic data, IP address, repository ID, location data, weblogs, search terms entered, account activity, and other communication data relating to the pages visited and resources that you access
  • Information you provide to us when you request information or research materials, and participate in promotions, contests, or giveaways

Please note that we do not attempt to collect personally identifiable information from children or persons under the age of eighteen (18) years of age. Any personal information sent to us which appears to be from a child will be deleted. We cannot always determine if a visitor to our website or the sender of an e-mail is a child, but we will exert our best efforts to do so.

When an existing or prospective client goes to www.andishere.com or contacts our Sales team to request information about ANDX products and services, he or she must provide contact details including person-specific information (name, title, phone number, and e-mail address) and organization-specific information (name and address). ANDX also collects some marketing contact information such as names and email addresses through third parties and uses this information for marketing purposes only. ANDX may also append the supplemental information in order to improve our website, products, and services.

When ANDX surveys customers on behalf of its clients, it may receive customers’ personally identifiable information from its clients in order to contact those respective customers. ANDX enters into confidentiality and non-disclosure agreements with clients that legally obligate ANDX to protect the personally identifiable customer information it receives and use it only for the purposes specified in the contract. From time to time, ANDX may collect personally identifiable information during a survey if requested to do so by a client. This identifiable information will be shared with the client if the customer agrees to do so and will be used exclusively as described at the time the information was collected.

ANDX may, with the written consent of its clients, ask questions of customers for whom it has received personally identifiable information, and bundle and sell those responses in an aggregate form. Before providing any survey results to third parties, responses are stripped of personally identifying or client-identifying information before it is aggregated and packaged for delivery.

ANDX does not collect sensitive information such as credit card numbers, social security or social insurance numbers, religious or philosophical beliefs, or trade union membership. ANDX will occasionally collect demographic information for statistical purposes and are entirely voluntary.

COOKIES & OTHER ELECTRONIC CAPTURED INFORMATION

ANDX and its service providers may use cookies and other technologies such as digital fingerprints to identify returning users from the same computer and help ensure the integrity of its research, as well as enhance the experience when interacting with various products and services, including our website. As part of its basic uses of Internet technology to provide a survey, ANDX may also collect technical information such as the customer’s IP address, internet service provider (ISP), the date and time when a customer accesses a survey, as well as other characteristics such as device type, operating system, and browser. In order to improve services to our clients and their customers, as well as provide further marketing, analytics, and site functionality, we may combine this information in the aggregate with other information.

In some cases, ANDX may ask a customer to provide their location data, including the real-time geographic location of the customer’s device, and will only be collected with the customer’s consent. The location based data allows ANDX to provide surveys that relate to a client’s specific business location and will only be shared with the client in accordance with this Privacy Policy.

PROTECTION OF PERSONALLY IDENTIFIABLE INFORMATION (PII)

ANDX is serious about protecting and ensuring any personally identifiable information that is collected or provided is kept strictly confidential and secure. We are not in the business of selling or sharing any personally identifiable information gathered on our website or in the course of client work to third parties. ANDX only shares information with third parties, such as its clients, only as described in this policy or as described at the time information is collected such as requesting an email address from a customer so that the client may conduct a follow-up. A customer of course has the option to refuse to provide this information, as well as participate in the survey itself.

VOLUNTARY PARTICIPATION

Individuals may choose not to participate in ANDX’s research and are under no obligation to conduct any of our surveys. For online surveys, an opt-out choice is included in communications to individuals where required, and those who exercise it will be added to ANDX’s opt-out list for the relevant client within ten (10) business days of unsubscribing. ANDX does not send survey invitations to any email address on the applicable opt-out list and also provides opt-out lists on a timely basis to a client or third-party contractors so that they may update their records where required.

Any individual receiving email from ANDX regarding our products and services also has an option to opt-out of all future communications about the products and services and will be updated within ten

(10) business days of unsubscribing. Individuals who wish to reverse an earlier unsubscribe option may contact ANDX to change their opt-out status at any time.

CUSTOMER ACCESS

Clients and customers may contact ANDX at any time if they feel there is an error in their personally identifiable information or request deletion of personally identifiable information. Due to the fact that ANDX generally receives and retains personally identifiable information as an authorized representative of a client, we will usually refer individual reporting inaccuracies in any personally identifying information to the originating source for correction, typically with the client.

Subsequent to verifying the identity of a person making a request, ANDX will respond to a request for offline access to personally identifiable information within 30 days of receiving the request.

DATA RETENTION

We will retain your information for as long as needed to provide the services for a client and is generally stated in any standard client contract and generally not longer than seven (7) years. If you wish to request that we no longer use your information to provide you our services, please feel free to contact us and we will coordinate with our client for which the data was collected. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

THIRD-PARTY PARTNERS

From time to time, ANDX may contract with third parties to perform functions necessary for its research operations and, under the terms of those contracts, may transfer data to those third parties. ANDX always requires any such third party to maintain the same rigorous process of confidentiality of such data.

SECURITY

ANDX understands and treats data security very seriously. Many of our clients operate in highly regulated industries like finance, healthcare, telecommunications, and hospitality. We maintain best-in-class security practices to protect the client’s and their customer’s data including encrypting data in transit and at rest, in secure SSAE-16 and ISO 27001 certified data centers with biometrics and video surveillance. In addition, security vulnerability tests and SOC 1 examinations are performed annually, as well as continuous internal network and external monitoring and alerting, and segregated duties and role-based access controls are in place.

LEGAL DISCLAIMER

When requested by legal authorities to disclose personally identifiable information, ANDX will inform the court of various factors justifying confidentiality and respondent anonymity. However, ANDX may be required by law to disclose personally identifiable information where judicial or other governmental subpoenas, warrants, or orders are properly issued or if ANDX reasonably believes that use or disclosure is necessary to protect its rights. In situations such as these, ANDX will communicate with the affected client as soon as possible unless prohibited by law or court order.

NOTIFICATION OF  CHANGES

ANDX reserves the right to edit this privacy policy at any time, and as required with the introduction of new products or services we may offer. Any changes to this privacy policy will be posted and dated accordingly, with a link on our company website www.andishere.com.
